1. Introduction
Welcome to HireFlock.ai ("Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our online hiring platform that connects recruiters, employers, and job candidates.
By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.
Platform Nature: HireFlock.ai operates as an intermediary platform that facilitates connections between recruiters/employers seeking to fill job positions and candidates seeking employment opportunities. We provide a technology platform and related services but are not a party to any employment relationship, hiring decision, or transaction between users of our Platform.
We reserve the right to modify these Terms at any time. Material changes will be notified through our Platform or via email. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.
2. User Eligibility
To use our Platform, you must meet the following eligibility requirements:
Age Requirement
You must be at least 18 years of age to create an account and use our Platform. By registering, you represent and warrant that you are 18 years or older and have the legal capacity to enter into these Terms.
Accurate Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Responsibility
You are solely responsible for all activities conducted through your account. You must immediately notify us of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this obligation.
Prohibited Users
You may not use our Platform if:
- You are under 18 years of age
- You have been previously suspended or banned from the Platform
- You are located in a jurisdiction where use of the Platform is prohibited
- You are using the Platform on behalf of someone else without proper authorization
3. Platform Fees
Certain features and services on our Platform may require payment of fees. By using paid services, you agree to the following:
Payment Processing
All payments for Platform services, subscriptions, job postings, or other features are processed securely through Razorpay, a third-party payment gateway service provider. By making a payment, you agree to Razorpay's terms of service and privacy policy.
Payment Authorization
When you make a payment, you authorize us (through Razorpay) to charge your chosen payment method for the amount specified. You represent and warrant that you have the legal right to use the payment method you provide.
Pricing Changes
We reserve the right to modify our pricing at any time. Price changes will be communicated to you in advance, and your continued use of paid services after the effective date of price changes constitutes acceptance of the new pricing. Price changes will not affect services already paid for during the current billing period.
Refunds and Cancellations
Refund policies vary by service type and will be clearly stated at the time of purchase. Generally, fees paid for completed services (such as processed applications) are non-refundable. Subscription fees may be refunded on a prorated basis if cancellation occurs within the refund period specified in your subscription agreement.
Failed Payments
If a payment fails or is declined, we may suspend or terminate your access to paid features until payment is successfully processed. You are responsible for any fees or charges incurred due to failed payment attempts.
4. User Obligations
As a user of our Platform, you agree to comply with the following obligations:
Prohibited Activities
You agree NOT to:
- Post Fraudulent Listings: Create fake job postings, misrepresent job opportunities, or post positions that do not exist or are not legitimate employment opportunities.
- Spam or Unsolicited Communications: Send spam, unsolicited messages, or engage in any form of automated messaging or bulk communications to other users.
- Data Scraping: Use automated tools, bots, scrapers, or any other means to extract, collect, or harvest data from our Platform without our express written consent.
- Impersonation: Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
- Harmful Content: Post, upload, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Security Violations: Attempt to gain unauthorized access to our Platform, user accounts, computer systems, or networks connected to our Platform.
- Interference: Interfere with or disrupt the Platform, servers, or networks connected to the Platform, or violate any requirements, procedures, policies, or regulations of such networks.
- Reverse Engineering: Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of our Platform.
Content Standards
All content you post, upload, or submit to the Platform must:
- Be accurate and truthful
- Comply with all applicable laws and regulations
- Not infringe upon the rights of any third party
- Not contain viruses, malware, or other harmful code
- Respect the privacy and rights of other users
Consequences of Violation
Violation of these obligations may result in immediate suspension or termination of your account, removal of content, and legal action where appropriate. We reserve the right to investigate violations and cooperate with law enforcement authorities.
5. Intellectual Property
Platform Ownership
The Platform, including but not limited to its design, functionality, source code, software, graphics, text, logos, icons, images, audio clips, digital downloads, and data compilations, is the exclusive property of HireFlock.ai and its licensors. All content is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
Brand and Trademarks
The "HireFlock.ai" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of HireFlock.ai or its affiliates or licensors. You may not use such marks without our prior written permission.
User Content License
By posting, uploading, or submitting content to our Platform, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with operating and promoting the Platform.
User Content Ownership
You retain ownership of the content you submit to the Platform. However, you represent and warrant that you own or have the necessary rights and permissions to grant the license described above, and that your content does not infringe upon the rights of any third party.
Restrictions
You may not:
- Copy, modify, or create derivative works of the Platform
- Use our trademarks, logos, or other proprietary information without permission
- Remove any copyright, trademark, or other proprietary notices from the Platform
- Use the Platform for any commercial purpose not expressly permitted by these Terms
6. Limitation of Liability
Platform as Intermediary: HireFlock.ai operates as an intermediary platform connecting recruiters/employers and candidates. We are not a party to any employment relationship, hiring decision, or transaction between users.
No Warranty for User Conduct
We do not endorse, guarantee, or assume responsibility for the conduct, performance, or actions of any user, including but not limited to:
- The accuracy, completeness, or truthfulness of job postings, resumes, or candidate profiles
- The quality, safety, or legality of job opportunities posted on the Platform
- The qualifications, skills, or background of candidates
- The conduct of employers, recruiters, or candidates during the hiring process
- The outcome of any hiring decision or employment relationship
No Warranty for Resume Accuracy
We are not responsible for verifying the accuracy, completeness, or authenticity of resumes, credentials, work history, or other information submitted by candidates. Employers and recruiters are solely responsible for conducting their own due diligence, background checks, and verification processes.
Platform Availability
We strive to provide continuous access to the Platform, but we do not guarantee that the Platform will be available at all times, uninterrupted, or error-free. The Platform may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
Limitation of Damages
To the maximum extent permitted by applicable law, HireFlock.ai, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, data, or business opportunities
- Costs of substitute services
- Damages arising from use or inability to use the Platform
- Damages arising from unauthorized access to or alteration of your data
- Damages arising from the conduct of other users
Maximum Liability
Our total liability to you for all claims arising from or related to the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars (₹1,000), whichever is greater.
Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain damages. If such laws apply to you, some of the above limitations may not apply, but our liability will be limited to the fullest extent permitted by law.
7. Termination
Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. Upon termination, your right to access and use the Platform will immediately cease.
Termination by Us
We reserve the right to suspend or terminate your account, restrict your access to the Platform, or delete your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms of Service
- Fraudulent, illegal, or harmful activity
- Non-payment of fees or charges
- Extended periods of account inactivity
- Requests by law enforcement or government agencies
- Discontinuation or material modification of the Platform
Effect of Termination
Upon termination:
- Your right to access and use the Platform will immediately cease
- We may delete or deactivate your account and all associated data
- You remain liable for all fees and charges incurred prior to termination
- Provisions of these Terms that by their nature should survive termination will remain in effect
Data Retention
We may retain certain information about you and your account after termination as required by law, for dispute resolution, or for other legitimate business purposes. However, we are not obligated to retain your data indefinitely.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Jurisdiction
Any disputes, claims, or controversies arising out of or relating to these Terms, the Platform, or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh, India.
Dispute Resolution
Before initiating any legal proceedings, parties agree to attempt to resolve disputes through good faith negotiations. If a dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015 of India, or through the courts as specified above.
Compliance with Indian IT Laws
Our Platform complies with applicable Indian information technology laws, including but not limited to the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We act as an intermediary as defined under Indian law and are committed to maintaining compliance with all applicable regulations.

10. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on the Platform, constitute the entire agreement between you and HireFlock.ai regarding your use of the Platform.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms or any rights hereunder without your consent.
Force Majeure
We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or internet or telecommunications failures.
